1. Introduction
These Terms of Sale govern all transactions made through bloomieapparel.com or any other Bloomie Apparel sales channel. By completing a purchase, you agree to be bound by these terms. Please read them carefully before placing an order.

2. Definitions
For the purposes of these Terms of Sale, the following definitions apply:
Sale: Any transaction in which you purchase a Product from Bloomie Apparel, including both physical items and digital services such as memberships.
Product: Any item or service purchased from Bloomie Apparel, including physical apparel and the Bloomie Premium membership plan.
Item: A physical product purchased from Bloomie Apparel, such as a bra or underwear.
Bloomie Premium: A recurring subscription membership plan offered by Bloomie Apparel, billed on a 30-day cycle.

3. Product Availability & Pricing
All products are offered subject to availability. Prices displayed on our website are in U.S. dollars by default and are shown at Bloomie Premium pricing. We reserve the right to correct any pricing errors and to cancel or refuse orders placed at an incorrect price.If a product you have ordered is unavailable or out of stock, we will notify you as soon as possible. At that point, you may choose one of the following:    
• Have your order fulfilled when the item becomes available, or    
• Receive a full refund for the unavailable item.
We will process your chosen resolution promptly upon notification.

4. Shipping
Bloomie Apparel will make reasonable efforts to ship your order in a timely manner. However, once your order has been handed off to the shipping carrier, Bloomie Apparel is not responsible for:    
• Delays caused by the carrier or circumstances outside our control    
• Packages lost in transit    
• Damage occurring during shipment
If you experience an issue with a lost or damaged shipment, we encourage you to contact the us and the carrier directly. You may also reach out to us at hello@bloomieapparel.com and we will do our best to assist, though resolution is at our discretion.

5. Payments & Billing
One-Time Purchases
For standard product purchases, you authorize Bloomie Apparel to charge your payment method on file via Stripe for the total amount of your order, including applicable taxes and shipping fees, at the time of purchase.

Bloomie Premium Membership
By enrolling in Bloomie Premium, you authorize Bloomie Apparel to charge your payment method on file via Stripe:    
• A recurring charge of $4.99 every 30 days thereafter purchase or full the following full calendar month, until you cancel your membership. You may cancel your Bloomie Premium membership at any time. Cancellation will take effect at the end of the current billing period. Bloomie Apparel reserves the right to modify the Bloomie Premium pricing with reasonable notice to subscribers.

All payments are processed securely through Stripe. Bloomie Apparel does not store your full payment card details on our servers.

6. Returns
All returns are subject to our separate Return & Refund Policy, which is incorporated herein by reference. Bloomie Apparel reserves the right to reject return or refund requests that do not comply with the terms of our Return & Refund Policy.Please review our Return & Refund Policy at bloomieapparel.com for full details on eligibility, timeframes, and the returns process.

7. Limitation of Liability
To the fullest extent permitted by applicable law, Bloomie Apparel shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the purchase, use, or inability to use our products.This includes, but is not limited to, damages or claims arising from:    
• Personal injury during physical activity    
• Discomfort, irritation, or allergic reactions    
• Improper fit or sizing issues    
• Product wear and tear from normal or intensive use
Our products are designed for general athletic and lifestyle use. They are not guaranteed to prevent injury, provide medical benefits, or meet any specific performance expectations.In no event shall Bloomie Apparel's total liability to you exceed the amount you paid for the product giving rise to the claim.

8. Assumption of Risk
By purchasing and using Bloomie Apparel products, you acknowledge that physical activity carries inherent risks. You agree that your use of our products is voluntary and that you assume all risks associated with physical activity and use of our products, to the extent permitted by applicable law.

9. Proper Use DisclaimerBloomie Apparel products are designed and intended for general athletic and lifestyle use. We are not responsible for any damage, injury, or dissatisfaction resulting from:    
• Improper sizing or fit    
• Use outside of intended athletic or lifestyle purposes    
• Failure to follow care or usage instructions provided with the productPlease refer to the care and sizing instructions included with your order or available on our website to ensure the best experience with your Bloomie Apparel products.

10. Governing Law
These Terms of Sale are governed by the laws of the United States and the state in which Bloomie Apparel operates, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the appropriate courts of that jurisdiction.

11. Changes to These Terms
Bloomie Apparel reserves the right to modify these Terms of Sale at any time. Updated terms will be posted on our website with a revised effective date. Your continued use of our website or purchase of our products following any changes constitutes your acceptance of the updated terms.
